From The Mind of Merc - Kilmar Abrego Garcia

Sometimes I find my mind wandering over various eclectic topics and occasionally I am inspired to write some of them down. Today I was thinking about Kilmar Abrego Garcia.

In the unlikely event that you haven’t heard of the complete sh*tshow that is the case of Kilmar Abrego Garcia, here’s a timeline of how it’s gone so far: 

March 15: Kilmar Abrego Garcia is deported to El Salvador for alleged links to the MS-13 gang (despite a protected legal status which precludes him from being deported to that country).

March 18: An ICE official confirms several of those detained have NO CRIMINAL RECORD. April 1: It’s reported Abrego Garcia was mistakenly deported to El Salvador due to an "administrative error".

April 4: Judge Paula Xinis orders the government to return Abrego Garcia to the United States by midnight on April 7.

April 7: Supreme Court Chief Justice John Roberts puts off Judge Xinis' midnight deadline.

April 8: The Trump administration claims the judge can't demand Abrego Garcia's return as it’s interference in foreign diplomacy.

April 9: Abrego Garcia's wife denies the allegation her husband is a member of the MS-13 gang.

April 10: The Supreme Court rules Judge Xinis "properly requires the Government to 'facilitate' Abrego Garcia's release from custody in El Salvador." But adds it may exceed her authority to insist they 'effectuate' her order. Trump’s team view this as a win for them.

April 11: Judge Xinis, arguing the Supreme Court has spoken, slams the Trump team’s handling of the case and orders "daily updates" on Abrego Garcia's status and efforts to bring him back.

April 12: It’s reported that Abrego Garcia is "alive and secure" in El Salvador's CECOT prison - no information is provided about efforts to return him to the United States.

April 14: Attorney General Pam Bondi says that Abrego Garcia's return is "up to El Salvador,". The El Salvadorian president says, "I don't have the power to return him to the United States."

April 15: Judge Xinis orders expedited discovery to resolve Abrego Garcia's wrongful deportation.

A DHS official claims they’re "prepared to facilitate Abrego Garcia's presence in the United States ... if he presents at a port of entry" -- but adds they don’t have the authority to extract him from "a foreign sovereign nation."

April 16: The DOJ says they’ll appeal Judge Xinis' ruling ordering them to facilitate his return.

Sen. Chris Van Hollen of Maryland travels to El Salvador to meet with Abrego Garcia.

April 17: The U.S. Court of Appeals for the 4th Circuit denies the Trump team’s effort to appeal Judge Xinis' order requiring it to facilitate Abrego Garcia's return.

Sen. Van Hollen succeeds in meeting with Abrego Garcia in El Salvador

April 18: Sen. Van Hollen reveals Abrego Garcia was transferred 9 days ago to another facility.

Trump posts a picture on Truth Social of Abrego Garcia’s hand with his tattoos annotated to imply connections to MS-13. Trump claims the annotations are also tattooed on his hand.

April 21: The Salvadoran government rejects Democrat lawmakers request to visit Abrego Garcia.

April 22: Judge Xinis orders the government to more fully answer and respond to discovery requests from Abrego Garcia's attorneys. This is then paused for 7 days.

April 29: Trump says he "could" secure the return of Abrego Garcia, and "if he were the gentleman that you say he is, I would do that" but adds, "I'm not the one making this decision."

April 30: Multiple sources suggest Secretary of State Marco Rubio has been in touch with El Salvador President about Abrego Garcia, although details are not clear.

May 7: Judge Xinis schedules a hearing for May 16 after the Trump administration invokes the state secrets privilege to shield information about its handling of the matter.

May 8: Attorneys for Abrego Garcia, saying they're "still in the dark" ask Judge Xinis to authorise depositions of additional officials.

May 13: Lawyers for Abrego Garcia push back saying that the government has produced no evidence that it's made "the slightest effort" to facilitate his release.

May 16: Trump’s team release Marco Rubio's May 5 declaration in support of the state secrets privilege claiming the disclosure of certain information requested by Abrego Garcia's attorneys "could be expected to cause significant harm to the foreign relations interests".

June 6: Abrego Garcia is brought back to the U.S. to face criminal charges for allegedly participating in hauling undocumented migrants from Texas to the interior of the United States. Pam Bondi, after saying for months that it could not bring him back, says, "Our government presented El Salvador with an arrest warrant and they agreed to return him to our country."

Abrego Garcia makes his initial court appearance.

June 9: Federal prosecutors argue that Abrego Garcia poses "a serious risk of flight,"

Abrego Garcia's attorneys argue the wrongful deportation case is not over until the government is "held accountable" for "its blatant, willful, and persistent violations of court orders at excruciating cost to Abrego Garcia and his family."

June 10: The DOJ calls Abrego Garcia's attorneys' request to continue their case "desperate and disappointing," and argue that they complied with the order to facilitate Abrego Garcia's return.

June 11: Abrego Garcia’s Attorneys ask Judge Xinis to impose sanctions on the Trump team for what they call "repeated violations of its discovery obligations".

June 13: Abrego Garcia pleads not guilty to human smuggling charges. Judge Holmes says she will wait to decide whether he should be released from custody pending trial.

June 22: Judge Holmes denies the government's motion to detain Abrego Garcia while he awaits trial -- but acknowledges that, if released, he will likely be apprehended by ICE.

June 25: Judge Holmes outlines Abrego Garcia's conditions of release on bond, but he remains in custody after the judge asks whether the government has the ability to prevent his deportation while he awaits trial.

June 26: Abrego Garcia's attorneys move to have him returned to Maryland while he awaits trial. The administration says it will seek to deport him to a country other than his native El Salvador.

July 2: Abrego Garcia’s attorneys argue he could "face persecution or torture if removed directly to various other countries," adding he was subjected to severe mistreatment while in CECOT.

July 7: Judge Xinis orders the Trump administration to produce witnesses who can testify about the government's plans should Abrego Garcia be released from custody.

July 10: An ICE official testifies about the process the government might undertake to deport Abrego Garcia should he be released from custody in Tennessee.

July 11: Abrego Garcia's legal team asks Judge Xinis to order that he not be removed from the United States without at least 72 hours notice should he be released on bond.

July 16: A federal judge says he will rule within the next week on Abrego Garcia's pre-trial detention, after government attorneys argue Abrego Garcia poses a public danger and flight risk.

July 21: Abrego Garcia's attorneys ask for a 30-day stay if he is released from custody while awaiting trial.

July 23: Judge Xinis orders the Trump administration to return Abrego Garcia to Maryland upon his release from custody, shortly before a judge in Tennessee pauses Abrego Garcia's release for 30 days. The judge notes the poor attempts made by Trump’s team to tie Abrego Garcia to MS-13 (with the hand tattoo annotations)

Aug. 19: Abrego Garcia's attorneys seek to dismiss the criminal charges against him, accusing federal prosecutors of "vindictive and selective prosecution."

Aug. 22: Abrego Garcia is released from custody in Tennessee into the custody of his brother in Maryland, with orders to report to the ICE office in Baltimore on Monday morning.

The Trump administration say they may seek to deport Abrego Garcia to Uganda.

Aug. 25: Abrego Garcia is taken into immigration custody upon checking in with ICE and is transferred to a detention center in Virginia. His attorneys say ICE may deport him to Uganda after he rejected a plea deal to be deported to Costa Rica in exchange for pleading guilty).

Judge Xinis says that the federal government is "absolutely forbidden" from deporting him.

Aug. 26: Attorneys for Abrego Garcia move to reopen his immigration case to seek asylum and allow Abrego Garcia to designate Costa Rica as the country of removal should he be deported.

Judge Xinis temporarily blocks the Trump administration from deporting Abrego Garcia until at least early October when his latest deportation court challenge is expected to be resolved.

Aug. 28: Abrego Garcia’s lawyers say their client has been “vilified” in the media and ask for all officials to "refrain from making extrajudicial comments …materially prejudicing" proceedings.

Sept. 5: The Trump administration says it will remove Abrego Garcia to El Salvador again if his immigration case is reopened and that it now plans to deport him to Eswatini, Africa.

So, to sum up, he was deported illegally, it was made clear he should have been brought back ASAP but wasn’t and that nothing’s been proven against him and Trump and his goons have basically stuck two fingers up at the law and said ‘F you – we’re doing it anyway.” So much for the land of the free(!)

From The Mind of Merc - Voting

Sometimes I find my mind wandering over various eclectic topics and occasionally I am inspired to write some of them down. Today I was thinking about the importance of using your right to vote.

(No - this is not going to be a Suffragist diatribe and yes - it's still on this month's theme of the tangerine manbaby in Washington.)

One of the biggest current concerns I think is the possibility of thinking that the prejudiced, discrimatory, and, in some cases, frankly disgusting actions and executive orders coming out of the White House are at the wish and approval of the majority of Americans as, obviously, the President is voted in by the majority.

This is wrong on 2 key points:
1) Donald Trump did not win the popular vote - he got in because of the first-past-the-post electoral college system they have in the US 
2) The majority of US citizens do not agree with his policies, views or actions

What Donald Trump's presidency proves is what happens WHEN THE MAJORITY DON'T VOTE.

America is currently discovering to its cost that assuming an unsavoury, unpleasant candidate will not get in purely because of their unfavourable characteristics will always be wrong as minorities (e.g. racists) always vote. So, if you don't bother, your inaction constitutes enabling behaviour as you're just holding the door open for the minorities to let their candidate (who shouldn't even be considered) waltz right on in.

But, as shown by the graphic above, that does not mean his viewpoint is preferred and it does not mean his actions are universally condoned so it is likewise incorrect and detrimental to tar all Americans with the same brush.
It is important to remember the majority of Americans are as appalled by us at the circus of horrors currently being enacted by the POTUS and his cronies and that they may be louder but they are not stronger so log as we do not let them or allow them to be.

From The Mind of Merc - Elections

Sometimes I find my mind wandering over various eclectic topics and occasionally I am inspired to write some of them down. Today I was thinking about elections.

One of the main things that always worries about elections when you have a perceptibly awful option that people presume that awful option doesn’t stand a chance and consequently they don’t bother to vote. Whenever people do that, that awful option regrettably stands an incredibly good chance.

The most memorable example of this for me (aside from the 2016 US Presidential election) will always be the 2002 French Presidential election. For this, the options were the incumbent Jacques Chirac, his sidekick, Lionel Jospin, and National Front candidate, Jean-Marie Le Pen. It was believed Le Pen didn’t stand a chance – who wants a fascist for President, right? – so the French people think they needed to vote. The result was Le Pen beat Jospin in the preliminary election to get through to the final round of voting. This shocked the French into action and Chirac won by a landslide but their initial laissez-faire attitude nearly meant a fascist taking control of their government.

In Britain we face the apparently obvious choice of Sunak and his self-serving, elitist cronies – who have crippled this country with their obscenely apparent money-grabbing ways – or frankly anyone else. Yet it is not a foregone conclusion that they won’t win. Aside from the fact that people still doubt Starmer’s credentials mean he’s a better option (even though it’s meant to be about policies not people and not a popularity contest), the polls confidently predicting Labour success  has the potential to produce the exact opposite effect to that it intends (as I fear).

Also, a big difference between us and the French election is the French get 2 goes – we don’t – that’s why we have to make it count.

So, on July 4th, it’s imperative we learn from the almost-mistake of the French. Whether or not the think the Tories stand a chance (and regardless of thoughts or opinion of Starmer and his promises), in order to make sure the Sunak et al aren’t allowed to continue running this country into the ground like it’s their own personal piggy bank – you must go out and vote. If you don’t, their supporters will – just like Le Pen’s.

Remember:
- Never take election results for granted.
- Never assume you don’t need to vote to get the result you want/expect.
- Never let those who are out to serve themselves be allowed to continue in their way unchecked and unchallenged.

The fat old Republican with power in his sights
With no need to ask others for funds
He’d dispose of healthcare and of course women’s rights
But would not get rid of those guns
The whole world it rose up in angry revolt
And they begged for all the Yanks to see
This great ignoramus so keen to be famous
With no sign of ability

It’s up to all of us now to show
Though a loophole allowed  him the white house to get
He’s not the one we want there - oh no!
Don’t agree with pol’cies of hatred and greed 
Or letting all the Russians take rein
So gather an army against Mr Smarmy
And don’t let him get in again

From The Mind of Merc - Alternative Definitions

Sometimes I find my mind wandering over various eclectic topics and occasionally I am inspired to write some of them down.Today I was thinking about people’s apparently varying definitions of supposedly common words.
To demonstrate this, I’m just going to leave this here:

Stable (adjective): sane and sensible; not easily upset or disturbed.

Genius (noun): an exceptionally intelligent person or one with exceptional skill in a particular area of activity.

From The Mind of Merc - Democracy

Sometimes I find my mind wandering over various eclectic topics and occasionally I am inspired to write some of them down. Today I was thinking about democracy.
This is a topic which could be discussed and debated at length so I will try to keep what I have to say succinct and short.

There seems to be an inherent issue with democracy. And to my mind it is that those in power have never truly grasped the concept – either through a lack of intelligence or a surfeit of arrogance.
When it first began to disseminate through society, those in power presumably thought they would be able to control it – through entities such as ‘rotten boroughs’ etc. Consequently those in power continue to fail to adequately and appropriately respond when faced with the voice of the people. They fail to listen to this crucial voice; presumably believing the people will do as their told. This is nothing new but in this modern age with the freedom of information etc it is less practical and less acceptable.
People will not be controlled but they will be heard – particularly in case of injustice and inequality - as has been demonstrated in the past by the suffragettes and by the more recent protests.

Democracy (from its original Greek origins) literally means ‘rule of the commoners’ and it should mean just that. If you are going to institute a democratic government then the voice of the people must be heard – otherwise it contradicts its own existence.
In a true democracy the voice of the people must be heeded and in the modern society cannot be ignored and the best response ultimately as to hear out those disenchanted with the current political paths being taken. If that means accepting that mistakes have been made and taking appropriate action then so be it but persisting with a flawed and unsubstantiated course of action can only lead to disaster.

A dictatorial leader should not be and is not accepted in modern day society. Any attempt to be so can and is being countered if it contravenes basic upheld laws and statutes. One such applicable ‘law’ in the current political situation is the Declaration of Independence which states that "…when a long train of abuses and usurpations…evinces a design to reduce them under absolute despotism, it is their right, it is their duty to throw off such government and provide new guards for their future security." Ergo if a dictatorial leader wants absolute control and attempts to exercise said control in an oppressive way then it is the ‘duty’ of the people to object. To ignore, disregard or, worse, ridicule these objections is tantamount to incitement. Indeed, history suggests that doing so can only result in one outcome – see England 1649, France 1789 and Russia 1917.

However, as John Lennon said “When it gets down to having to use violence, then you are playing the system’s game. The establishment will irritate you – pull your beard, flick your face – to make you fight. Because once they’ve got you violent, then they know how to handle you. The only thing they don’t know how to handle is non-violence and humor.”
Ergo violence is not the answer as by getting violent you give your opponents ammunition, you sink to their level and you play their game. But likewise neither is arrogance, ignorance or disregard of widely held standpoints the solution.

In the end, ears must be open, all voices must be heard and only then can true co-operation take place and democracy truly exist and succeed.

From The Mind of Merc - US Election

Sometimes I find my mind wandering over various eclectic topics and occasionally I am inspired to write some of them down. Today, as with the rest of this month,  I was thinking about the US election.

If you voted for Trump then I’m sorry but I just don’t understand your choice.
I’ve no doubt you had your reasons I just hope they weren’t the same as the rest of his supporters.
You may have chosen to support him as an alternative to Hillary or because you’re anti-Democrat but what his biggest fans voted for was the wall to keep out immigrants, the deportation of all non-white people, the right to treat people like slaves and women like objects.
You may not agree with these viewpoints but thanks to you, the man who embodies them is now the man in charge of the ‘Free World’/Commander-In-Chief of the USA.

If you voted for Trump but don’t believe in his policies – you are an enabler.
If you didn’t vote for either candidate – you are a bystander.
And these two types of people can be just as dangerous as the people who commit evil acts because they allow the evil acts to happen.
Don’t be an enabler or a bystander – be a stander, be a fighter. Stand up for equality, fight against discrimination.
The US election was the battle – it was not the war.

To those, like me, who are scared at the changes that are already occurring in American society:
Do not give up
Do not hide away
Do not live in fear
His supporters may be numerous but they are not the majority (they weren’t even the majority of the votes but let’s not go there).
The best way to deal with a threat is to use it to make yourself stronger and that’s what we should do. Band together, stand up for each other, show these discriminatory, uneducated bigots that their behaviour is NOT what makes America great again.
Above all don’t accept the behaviour – report it, stand up against it (within reason – i.e. don’t put yourself at risk), speak out to condemn it.
They may be right-wing that does not make them right. They are in fact little better than terrorists and I would hope that such a thought would shame them into reconsidering their actions (although sadly I doubt it). A terrorist is defined as someone who uses intentionally indiscriminate violence (terror) in order to achieve a political, religious, or ideological aim - can you think of a better word to describe people who accuse, abuse and assault people simply because they have a different skin colour, religion or gender?
And now they are shedding their civilised camouflage to show their true terrorist colours. Well, shame on them! All that does is make them easier to spot, to isolate and to deal with. They should not be fooled into believing that suddenly their unacceptable behaviour is acceptable – it’s not, it never has been and it never will be and the sooner they are educated to understand that the better. Prejudiced violence will not make their country great again.

Some parents are concerned about what this teaches children and what they positively say about the situation.

But the lesson for children from the US election is not ‘If you are a misogynistic, racist, sexist bully then you can become President’ but ‘If you don’t stand up to misogyny, bigotry and racism and don’t use your vote when it matters, this is what happens’ and what must never be allowed to happen again

Oh Dear What Can The Matter Be (Part 2) - !!!NEW!!!

Following on from my previous parody of Oh Dear What Can The Matter Be (see here), I decided that the situation in America warranted its own version. And here it is:

Oh Dear, What Can The Matter Be also not by Anon
Oh dear, what can the matter be
America has voted Trump in, you see
Now he’s in charge of their Presidency
What on earth have they done now?

Despite the pleas of tons of celebrities
They thought he’d help to destroy the disease
That they feel’s destroying the colonies
What on earth have they done now?

We thought that they would come to see sense one day
Not let bigotry and racism hold sway
Supremists are now shouting hip-hip-hooray
What on earth have they done now?

It’s viewed as a win for groups like the KKK
For them it’s a glorious red letter day
They think that they now have a chance to stay
What on earth have they done now?

Hate and violence are all over the TV
Pain and suffering seems to be all we see
Extremist groups are filling the country
What on earth have they done now?

But
It’s not the end of the world – oh no, it’s not
Trump has won but he’ll never be on top
Haters will hate but then we will make them stop
That is what we must do now

The racist groups are the ones in decline
They’ve kept their colours hidden all this time
But they’ll see their views still won’t tow the line
That is what we must do now

We won’t give in to petty in-fighting
We must stay strong and keep on wrong-righting
Show them how to keep letting the light in
That is what we must do now

Trump wants to cause lots of division
But if that happens is not his decision
We will force him to make a revision
That is what we must do now

Oh dear, what can the matter be
America has voted Trump in, you see
But he doesn’t speak for all of us you’ll see
We will show them all and how
